Can You Be Fired During Your Resignation Notice Period?

No—not if your covered by unfair dismissal laws, then they cannot simply fire you while serving your notice ‘for no reason.’

If you’ve handed in your resignation and are serving your notice period, you’re still legally employed. If your employer then chooses to end your employment early, they are effectively dismissing you. And if you’re protected under the Fair Work Act, they must have a valid reason and they must follow procedural fairness.

Even during a notice period, they can’t be dismissed for nothing, unless you don’t meet the eligibility for unfair dismissal (e.g. under the minimum employment period) and its not connected to a workplace right (e.g. taking leave or raising a concern), which would give rise to a general protections claim.
